Welcome to DubaiOTC, an Over-The-Counter (OTC) platform for exchanging cryptocurrency to fiat and fiat to cryptocurrency. Our platform facilitates secure and efficient transactions between users.
2. Acceptance of Terms
By accessing or using our platform, website, or any related services (collectively referred to as the Services), you agree to comply with and be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use our Services.
3. Modifications
We reserve the right to modify these Terms at any time. Any changes will be effective immediately upon posting on our platform. Your continued use of our Services after any such changes constitutes your acceptance of the new Terms.
4. Definitions
"Platform" refers to DubaiOTC and all its associated services. "User," "you," or "your" refers to any individual or entity using our Services. "We," "us," or "our" refers to DubaiOTC and its affiliates. "Cryptocurrency" refers to digital or virtual currencies using cryptography for security. "Fiat currency" refers to government-issued currency designated as legal tender.
5. User Obligations
• You must be at least 18 years old and have the legal capacity to enter into a binding agreement. • You must not be in a country where crypto trading is prohibited. • Provide accurate, current, and complete information during registration. • Only one account is allowed per user unless permitted. • You are responsible for safeguarding your password and account. • Notify us of unauthorized access or breaches immediately. • Comply with all laws and tax obligations.
6. Account Management
• You agree to provide KYC/KYB documents as needed. • We may verify identity through third-party services. • We may suspend/terminate accounts for violations, inactivity, or compliance reasons. • You may request retrieval of funds post-termination, subject to laws and fees.
7. Transaction Processing
• Buy/sell crypto using bank transfers, SWIFT, cash, and more. • Supported currencies may change at any time. • All applicable fees will be disclosed and may change. • We may set transaction limits based on verification level and history. • Orders can only be canceled if not matched. • Final prices may differ from quoted rates due to market volatility.
8. Dispute Resolution
• Contact support via Telegram first. We’ll respond within 2 business days. • Unresolved issues will be handled through binding arbitration via DIAC in Dubai. • Arbitration language is English. Costs are borne by each party unless otherwise decided.
9. Class Action Waiver
You agree to resolve disputes individually and not as part of a class action or group proceeding.
10. Limitation of Liability
• Services are provided "as is." • We are not liable for indirect or incidental damages. • Direct liability is limited to fees paid in the past 12 months.
11. Force Majeure
We are not liable for issues caused by forces beyond our control (e.g. natural disasters, war, internet outages).
12. Intellectual Property
• All platform content is protected by copyright and belongs to DubaiOTC or its partners. • Our brand and design assets are trademarked.
13. Privacy and Data Protection
• We collect and use your data in accordance with our Privacy Policy. • By using our platform, you consent to this use. • We employ security measures to protect your data.
14. Governing Law and Jurisdiction
These Terms are governed by the laws of the UAE. Disputes are handled in Dubai courts unless resolved via arbitration.
15. AML Policy Disclaimer
• We follow strict AML (Anti-Money Laundering) regulations. • KYC checks, transaction monitoring, and reporting are in place. • Users must comply, or face suspension and legal action.
16. Miscellaneous
• These Terms are the full agreement between you and DubaiOTC. • Invalid clauses do not affect the rest of the Terms. • You may not assign these Terms without permission. • We may assign them freely.
